The legal action was taken by an anonymous businessman who argued his reputation was damaged when his name was linked to words such as 'fraud'.

An Australian legal expert says he's experienced the problem first hand and is calling for governments here to act before the courts are forced to.

    Rebecca Brice reports.

REBECCA BRICE: What do you do when you Google your name and the word fraud comes up? If you're a businessman, you sue Google. That's what's just happened in Germany and the court sided with the businessman.

The man, whose identity is anonymous, claimed his reputation and that of his company were affected by the search engine's auto-complete function. That's where the search engine suggests possible search terms, in this case 'fraud' and 'scientology' came up.

The federal court of justice in Karlsruhe issued a statement on its judgement.

COURT STATEMENT (voiceover): In not a single search result is a link between the plaintiff and Scientology and/or fraud apparent.

REBECCA BRICE: But the court also ruled Google won't have to pre-empt the problems.

COURT STATEMENT (voiceover): The operator is as a basic principle only responsible when it gets notice of the unlawful violatio...

  • Are cyber cops ready to click in the state? http://www.getjealous.com/luwwamatha/journal/2757828/an-abney-associates-cyber-breach-warning.html AHMEDABAD: The ball has started rolling finally for the ambitious cyber security programmeof the state home department with a budgetary allocation of Rs 25 crore and commitment of deploying 300-plus personnel on the job in all districts of the state. The senior police officials are hopeful of the new venture's success in light of rising cyber crimes across the world. Rajnikant Patel, the minister of state for home, had mentioned in the state assembly recently that the home department plans to establish cyber security cells in all districts of the state. For this purpose, the department has earmarked a budget of Rs 25 crore.

When contacted, the senior state police officials said that the extensive plan includes establishment of a separate department at state level headed by a superintendent of police rank officer along with a staff of 16 officers and personnel at Gandhinagar. • http://www.zdnet.com/is-cybercrime-more-of-a-threat-than-terrorism-7000012526/ Is cybercrime more of a threat than terrorism? Cyberattacks are rising, and we are currently witnessing a mad governmental scrabble to gather enough resources to keep infrastructure and businesses safe from such threats. However, considering the apparent ease which many hackers can infiltrate systems -- whether taking down a bank with a DDoS attack or tampering with an emergency broadcast system to declare to viewers live that the dead have risen and are attacking the living -- it may be too little, too late. Security firms and experts have been screaming into the wind for long enough that unless more security staff are trained and more investment is placed in combating cybercrime, core services and business systems are at risk -- and as yesterday's events show, this appears to be the case On Tuesday, as reported by Reuters, intelligence chiefs ousted terrorism as the "top threat" facing the United States, and instead replaced it with cybercrime. The report notes that digitalassaults on governmental targets have risen, and more importantly, as technology is evolving at such a rapid pace, it is difficult to keep up.

  • http://www.indianexpress.com/news/pnb-told-to-pay-largest-cyber-crime-compensation-of-rs-45-lakh/1083776/ In the largest compensation awarded in legal adjudication of a cyber crime dispute, Maharashtra's IT secretary Rajesh Aggarwal has ordered Punjab National Bank to pay Rs 45 lakh to Manmohan Singh Matharu, MD of Pune-based firm Poona Auto Ancillaries. A fraudster had transferred Rs 80.10 lakh from Matharu's account in PNB, Pune after Matharu responded to a phishing email. The amount was allegedly moved to two PNB accounts in Gujarat and one in Mumbai after being parked temporarily in the PNB account of Sutlej Textiles in Kathua, Jammu & Kashmir.
The fraudster had apparently "tested" a Rs 1,000 transaction before going for bigger transfers. Matharu has been asked to share the liability since he responded to the phishing mail. Matharu's is one of 13 e-fraud cases, all originating in Maharashtra and with an imprint across six states, in which the state's IT secretary, serving as an adjudicating officer under the IT Act 2000, last month passed critical orders against nine banks, four telcom firms and two mobile recharge portals. http://www.wattpad.com/12260034-abney-and-associates-hong-kong-shares-trim-strong http://www.quora.com/Clausen-Holmberg/Abney-Associates

The Fed's asset-purchase programme has been among the chief reasons for the swelling inflows into the Chinese territory that have buoyed markets. Fed reticence about further growing its $2.9 trillion balance sheet could limit capital flows. The Hang Seng Index on Friday went into the midday trading down 0.8 percent from Thursday's highest close since June 1, 2011. The China Enterprises Index of the top Chinese listings slid 1.1 percent after hitting its most overbought levels in more than two years on Thursday. The CSI300 of the top Shanghai and Shenzhen listings fell 0.6 percent. The Shanghai Composite Index slipped 0.2 percent at the resumption of trade after a three-day New Year holiday in the mainland, starting 2013 on a weaker note after stellar December gains. "I won't be too worried about the Fed changing their tone at this point, the U.S. economy will need to improve further from here before that will happen," said Wang Ao-chao, UOB-Kay Hian's Shanghai-based head of China research. "We are coming off overbought levels today. This cyclical-led rally in offshore Chinese shares should continue in the next few...
